According to Sabrina's reports on social networks, the attacker began to threaten her daily. Among the intimidations were the threat of publishing intimate photos and videos, sensitive personal data and, finally, attacks on Sabrina's life.
According to Sabrina, the threats occurred not only in gaming environments and platforms connecting gamers (the well-known Discord). The influencer's social networks, including WhatsApp, were also the target of threatening and intimidating messages.
After receiving an alert from another player, Sabrina went in search of the protective measure, which was granted by the Court of Domestic and Family Violence Against Women in São José dos Campos. However, the path to reach the protective measure was marked by prejudice and denial.
As it is a virtual crime, several police units did not understand that it was possible to apply the Maria da Penha Law, which does not provide for specific situations of threats in online environments.
This is because criminal law is usually applied only when there is an exact coincidence between the fact provided for in the law and the action taken by the aggressor.
Thus, different police authorities understood that the urgent protective measure was not applicable, as it did not fall under Law n. 11.340/06.
Only after looking for the Public Defender's Office did Sabrina get someone to listen to her to request the protective measure, which was granted based on the psychological violence provoked in the gamer through the threats of leaking intimate photos, videos and even death.
Thus, the protective measure was granted involving online games, including metaverse, and determines that the aggressor maintains any type of contact with the victim, whether by virtual or physical means.
On Twitter, Sabrina celebrates his victory and states that “Internet is not land without law”.
