An unprecedented episode came to pass recently. A woman, resident of the city of Campo Erê, located in the state of Santa Catarina, found a mouse decaying into a single tomato sauce sachet.

The illustrious event made the Court of Justice of Santa Catarina (TJSC) decree a payment order, in the amount of R$ 10 thousand, as compensation for moral damages.

The decision was announced on June 1. However, the case is not so recent. The story has been unfolding since 2020.

According to the information provided by Justice, the woman bought the product and when she decided to open it in order to prepare dinner, she found the animal dead, in a state of decomposition.

The testimonies indicate that the son and the husband witnessed the scene and even recorded a video, so that what had happened was recorded. After that, the family took the sachet to the store where it had been purchased.

Therefore, the client started a lawsuit, and Judge Paula Fabbris Pereira, after closely checking the case, decided to decree a payment of R$ 10,000 for pain and suffering.

However, the company, responsible for producing the sachet, Fugini Alimentos Ltda, he filed an appeal, stating that there was no indication that the product would be contaminated, if it were, the packaging would be “stuffed”.

However, in response to the appeal made by the company, the rapporteur Luiz Felipe Schuch, claimed that this does not depend on the demonstration of guilt or not. “Proof of harmful conduct, damage and causal link is enough”, he said.
