Contran's decision
The growing popularity ofelectric bikes and scooters on public roads led traffic agencies to realize the need to establish clear and specific guidelines for them.
In this way, the new resolution appears as an answer to the great doubt that permeates the population: are there motorcycles that do not need a license?
According to the definitions established by Contran, a moped is considered a vehicle with two or three wheels, equipped with an engine of up to 50 cm³ and limited to a maximum speed of 50 km/h.
In turn, the bicycle is defined as a human-powered vehicle, consisting of two wheels, which do not resembles motorcycles, scooters and mopeds, as established by the Brazilian Traffic Code (CTB).
In addition, the resolution includes self-propelled individual mobility equipment, such as scooters, skateboards and motorized unicycles.
Motorcycles that can be ridden without a license
The answer about which motorcycles do not need a license is straightforward: currently, in Brazil, there is no motorcycle model that does not require National driving license (CNH) or Authorization to Drive Mopeds (ACC). Therefore, all vehicles of this type must be duly registered and licensed, and the driver qualified.

In the specific case of mopeds, motorcycles and scooters, registration and license plates are mandatory. To drive them, it is necessary to issue an ACC or CNH in category A.
On the other hand, electric bicycles and self-propelled personal mobility equipment, such as scooters vehicles, are exempt from the driving requirement and can circulate under the same conditions as bicycles conventional.
However, it is important to highlight that electric bicycles must meet certain specifications to fall into this category. They need to be equipped with a system that ensures engine operation only when the driver is pedaling, in addition to having a speed indicator.
If the electric bicycle has a throttle on the handlebars, it is considered a moped and is therefore subject to registration, licensing and driving by a qualified person.
The resolution also highlights the importance of safety items for riding electric bicycles, such as a bell, front and side night signals and rear-view mirrors.
