In this sense, currently, a holiday is not necessarily synonymous with rest. This is because there are different types of working hours, and in some of them work is provided even on public holidays.

When can you work on holidays?

In some cases, for example, when the worker works on a shift or shift schedule, regardless of the date, it is necessary to be present at the job. However, it is necessary for the employer to comply with what is provided for by the Consolidation of Labor Laws (CLT).

What the CLT x labor reform says

First of all, according to labor laws, every worker must have the right to rest on public holidays, or double pay if compensation does not occur in the same week.

This way, it works as follows: if the holiday day is compensated with time off on a different day of the week, the contractor does not need to pay twice as much for the day worked.

However, with the labor reform, there is now the possibility of reaching an agreement. It works like this: there must be an agreement between the employer and the employee, so employees can make compensation in the hour bank.

In other words, if it is by common agreement, the employee will work on the holiday and, instead of receiving double remuneration, he will have the hours allocated to his bank of hours at the company.

In addition, the labor reform changed the question of workers who work on a 12×36-hour shift. By understanding that compensation already occurs naturally, given that this scale model already provides for a day off after working hours, work on holidays is no longer remunerated.
