STF can change the way Brazilians use the internet

For deliberation, the two cases evaluated were the social networks Orkut (formerly Google's network) and Facebook. The debate brings out the fine line between freedom of expression and harming others.

Currently, in Article 19 of the Marco Civil da Internet, the law supports and defends freedom of expression, such as preventing censorship.

Minister Dias Toffoli's report refers to Facebook, saying that a certain woman requested that the company remove a false profile that was impersonating her.

The victim was the target of offenses from known people, but the platform did not act to defend her, causing the case to go to court.

Another feature was reported by Minister Luiz Fux, about Orkut, which belonged to Google. A teacher from Minas Gerais saw a community on the platform that criticized her and promptly asked the social network to remove the community from the air.

Orkut did not accept the request, also causing the case to be judged.

Internet framework may change

These were isolated cases presented at the public hearing, as many other recent reports have been presented. There were reports of explicit acts of violence on the platforms during the period of the 2022 presidential election.

Initially, it is expected that this discussion may lead to changes in the Civil Rights Framework for the Internet. There are still no dates for the trial, but the case's rapporteurs believe they were able to gather the greatest amount of information for the case to be properly analyzed.
