Types of Marital Status
1. Not married
It is the person who has never been married, regardless of whether he has a stable relationship or not.
2. Married
It is the individual who has a matrimonial union through civil marriage, regardless of the property regime adopted.
3. Separate
He is the one who no longer lives with his partner, but is not yet divorced (a). The person who is separated, can decree legal separation, to end the duties of the marital society.
4. Divorced
It is the person who had his/her request for divorce approved through the courts, or through a deed.
5. Widower
It is the individual whose spouse has passed away.
Other forms of union that do not constitute a marital status
A stable union is the coexistence between people who do not have any impediment to marry, but for their own reasons, did not do so.
A stable union, despite not being considered a type of marital status, is legally recognized and considered as a family entity, but to fill out an official document, the person is single.
The coexistence between a man and a woman who are prevented from marrying is called concubinage. For the law, concubinage is not considered a family entity, but a de facto society.
Therefore, unlike a stable union, it is not covered by family law, and must be judged by the rules of the law of obligations.
